ATIPP - Public Bodies

The purpose of the act is to

  • make public bodies more accountable to the public, and
  • to protect personal privacy of individuals whose information is in the custody or control of a public body.

Apart from the personal privacy provisions, the act does not restrict or replace any other procedures a public body may have in place to give the public access to information.

In the spirit of openness and accountability on which the act is based, public bodies should make a deliberate effort to make their information easily accessible outside of the formal ATIPP process.


Access to Information Provisions

The act prescribes in detail how a public body will respond to access requests from the public.

Obligations include the following:

  • Duty to assist,
  • Time limits,
  • Provisions for charging fees,
  • Liaison with a central contact point, the “Records Manager”,
  • Consultation with third parties, and
  • Exceptions and exemptions.


Protection of Privacy Obligations


With respect to personal information, the act prescribes obligations regarding the following:

  • When and how personal information can be collected,
  • What personal information can be used for,
  • Retention of personal information after it is used for a decision,
  • Protection and disclosure of personal information, and
  • Handling and recording requests for correction to personal information.

Public Bodies


The act applies to all records held by a public body:

  • all Yukon government departments,
  • secretariats and other similar executive agencies of the Yukon government, and
  • additional public bodies explicitly designated in the Designation of Public Bodies Regulation pursuant to the act.

The act does not extend to municipal bodies, and explicit exclusions in the act cover the Legislative Assembly, electora officers and courts.

  • Yukon Workers’ Compensation Health and Safety Board
  • Child and Youth Advocate
  • Designated Agency under the Adult Protection and Decision Making Act
  • First Nation service authority designated under the Child and Family Services Act
